Navigating the Job Check Process: Key Insights for Accredited Employers

18 November 2024

The Job Check is the crucial second step in the Accreditation process—but it’s also one of the trickiest. Things can get complicated fast, and errors at this stage can lead to unnecessary delays and expenses. Only once the Job Check is approved can a migrant be invited to apply for an Accredited Employer Work Visa (AEWV) or a Variation of Conditions (VOC) for an existing AEWV.

Job Check Milestone Update

As of October 23, 2024, Immigration New Zealand (INZ) has approved over 47,800 Job Check applications, covering more than 229,900 positions under the AEWV scheme. After significant delays, INZ is now prioritizing certain categories of job checks, helping expedite processing.

However, it’s essential for businesses to get this step right the first time. A flawed Job Check can leave your candidate in a prolonged “limbo” if concerns are raised by an INZ officer. This FAQ highlights some of the hidden complexities in Job Check applications, providing the insights you need to avoid setbacks.

Frequently Asked Questions

Can an employer apply for a Job Check if their accreditation has expired?

Employers can only apply if they have a valid accreditation, interim accreditation, or an accreditation renewal in process. If accreditation has expired and no renewal has been filed, the business cannot apply for a Job Check.

Can a Job Check be for a part-time job?

No, the job must offer a minimum of 30 hours per week.

What salary requirements apply?

INZ ensures the business offers at least the market rate and a minimum of $29.66 per hour (the median wage as of February 2023). Certain exemptions apply for specific jobs in tourism and hospitality, which require at least $28.18 per hour, as well as for specific sector agreements.

Is advertising necessary for a Job Check?

Yes, unless the job pays 200% of the median wage or is on the Green List.

What details should the job advertisement include?

For jobs paying below 200% of the median wage and not on the Green List, the advertisement must clearly state terms and conditions, including pay range, minimum guaranteed hours, location, and job requirements. These must align with the Job Check application.

INZ is strict about advertising outcomes—any tips?

Advertising proves you couldn't find a suitable New Zealander for the role, but in today’s market, this can be challenging. You might receive numerous local applications, so it’s vital to clearly outline the role requirements. Ensure your candidate meets these criteria to avoid complications.

What role does ANZSCO play in Job Checks?

ANZSCO codes are central to Job Checks. They influence everything from job requirements to salary and visa duration. ANZSCO levels 1, 2, and 3 can lead to five-year visas with potential residence pathways, while levels 4 and 5 offer two-year visas with stand-down periods. Selecting the wrong code can affect the Job Check, visa, and even the candidate’s residence pathway.

Is there a job quota for employers?

Standard Accreditation employers can associate up to five jobs at once, while High Volume Accreditation has no cap.

Can multiple positions be included in one Job Check?

Yes, provided all positions meet the same requirements.

How long is a Job Check valid?

Six months (minus a day) or until accreditation expires, whichever is sooner. If accreditation is suspended, Job Checks cannot support an AEWV application.

What if the Job Check isn’t approved?

A reconsideration request can be filed within 14 days of the decision.

What are the fees?

Each Job Check costs $735, with an additional $250 for reconsideration of a declined application.

Are there exemptions for jobs below the median wage?

Yes, certain roles in tourism, hospitality, and sector agreements like care work, transport, and seasonal roles may qualify for lower wage thresholds.

Why is selecting the correct ANZSCO code critical?

Choosing the wrong ANZSCO code can lead to Job Check delays or rejections. For example, a skill level mismatch can require additional steps, such as engaging with Work and Income. Accurate code selection is essential for policy compliance.

How can employers find the right ANZSCO code and skill level?

Use the Aria tool on the Statistics New Zealand website, or consult a Licensed Immigration Adviser for expert alignment with ANZSCO classifications and immigration requirements.
